What is a Vaccine Injury
A vaccine injury takes place when a vaccination results in a severe or debilitating reaction or health problem for the patient receiving the vaccine.
For the past century, people have relied on vaccines to protect themselves and their children from contagious disease. While the majority of vaccines are administered without incident, it sometimes happens that a patient undergoing vaccination may experience an adverse, unexpected reaction to the vaccine or the way it is administered. This is what is known as a vaccine injury.
Vaccines consist mainly of a small amount of bacteria, a virus, or another antigen—essentially, the organisms that cause debilitating or life-threatening disease.
Introducing these bacteria into the body is what triggers the body to develop immunities to the disease, which can save a person’s life if they ever come into contact with those disease-causing bacteria again.
Unfortunately, a small percentage of the population can have an adverse reaction to a properly administered vaccine. These injuries can be life threatening and life altering.
The US government currently recognizes vaccine injury as a “vaccine adverse event.” The Centers for Disease Control and Prevention have created a system where patients who experience health problems in the wake of vaccination can report their vaccine injury. The hope is that this system will help vaccine developers detect safety issues with existing vaccines.
However, reporting a vaccine injury to the proper authorities is only the first step in solving a personal health crisis that takes place as a result of vaccination. If you or someone you love has been the victim of a vaccine injury, you want more than to simply report the incident. You want your health restored and to have access to the best treatment available.
It’s important to know that the key to receiving justice and moving forward with your recovery may be enlisting the help of a lawyer specializing in vaccine injury cases.
Vaccine Injury Statistics
The Centers for Disease Control and Prevention (known as the CDC) keeps an ongoing record of the statistics surrounding vaccine injury. This database, known as the Vaccine Adverse Event Reporting System (VAERS) allows patients and caregivers as well as doctors, nurses and other physicians to report information about vaccine injury.
In making the VAERS available to the public, the CDC is adamant that the database does not evaluate the submitted information for scientific accuracy, nor does it test the information for positive proof of a cause-and-effect connection between the reported health problems and any given vaccine. In other words, the CDC does not consider the information within the VAERS to be proof of any given vaccine injury.
Since 2006, the database has collected close to 20,000 reports of vaccine injury classified as “serious,” meaning that the reports involve cases of debilitating or life-threatening injury and/or death.
For the year 2014, the VAERS database included 1,244 cases of people being hospitalized, 416 reports of disability following a vaccine injury, 388 life-threatening cases of vaccine injury, and 122 deaths possibly resulting from vaccine injury.
The CDC also notes that approximately 30,000 VAERS reports are filed each year.
The National Compensation Program For Victims of Vaccine Injury
In the 1980’s, the National Vaccine Injury Compensation Program was formed. This program was created to help compensate the victims of vaccine injury, and is funded by a government-mandated excise tax on vaccines that are recommended by the CDC for routine administration to children. Since 1988, the National Vaccine Injury Compensation Program has processed 13,747 claims for cases of vaccine injury. Of those claims, 3,887 have resulted in compensation awards. In any given year, the National Vaccine Injury Compensation Program pays out an average of 155 claims to affirmed victims of vaccine injury.
The U.S. Department of Health and Human Services points out that these settlements “are not an admission by the United States or the Secretary of Health and Human Services that the vaccine caused the petitioner’s alleged injuries.”
Reactions and Vaccine Injury Symptoms
A vaccine injury can range from brain damage to chronic illness and, in some cases, death. Symptoms of vaccine injury can arise within as few as 4 hours after the vaccination to a few weeks after administration.
Below are a list of commonly reported health problems and conditions resulting from vaccine injury:
- Anaphylactic shock
- Chronic arthritis
- Transverse Myelitis
- Brain injury
- Joint pain
- Gullian-Barré Syndrome/Disease
- Brachail Neuritis
- Shoulder Injury Related to Vaccine Administration (SIRVA)
If you or someone you love is experiencing any of these reactions following a vaccination, it is strongly suggested that you see a doctor.
How to File a Vaccine Injury Claim
If you believe that you or someone you love is the victim of a vaccine injury, your first recourse is to report the vaccine injury. The natural instinct is to tell your doctor about the vaccine injury. While this is a good first step, you should be aware that an estimated 90% of doctors fail to make an official report of suspected vaccine injury to the proper authorities.
For many victims of vaccine injury, filing a claim and seeking financial compensation is the key to moving forward with their lives. Recovery from a vaccine injury takes not only time, but a great deal of financial resources to help with medication, hospital stays, transportation, ongoing therapy and other medical costs. A knowledgeable lawyer who specializes in vaccine injury cases and covered vaccines can handle all the complicated work of filing the claim and help ensure that you receive all the compensation to which your vaccine injury entitles you.
