If you or a loved one have had a DePuy elbow implant and is experiencing pain or complications, you may be entitled to compensation. More than 50,000 of these implant devices have been voluntarily recalled by DePuy, according to the U.S. Food & Drug Administration (FDA), due to the possibility that the radial steam may loosen at the stem bone interface after elbow replacement operation.

This product poses a danger to patients who have received the implant. The Pittman, Dutton, Hellums, Bradley & Mann defective medical device lawyer team is currently representing patients who have been implanted with the device and have experienced medical complications because of it. We represent clients across the United States and can help you.

What Are the Reported Side Effects From DePuy Elbow Implants?

  • DePuy and the FDA first initiated the Class 2 Device Recall of the DePuy Synthes Radial Head Prosthesis System in December 2016.
  • The 50,311 units were distributed throughout the United States.
  • Some of the negative side effects patients with the DePuy elbow implant have reported include bone loss/osteolysis, bone fracture around the implant area, impaired range of motion and joint mechanics, irritation or damage to the soft tissue and severe pain.

How Was the DePuy Elbow Implant Used?

The DePuy elbow implant is a medical device used for patients who have undergone elbow replacement surgery. This procedure may have been recommended to patients who have had severe elbow pain and disability, stemming from issues including stiffness and cartilage loss. Elbow replacement surgery may have been recommended for patients including those who had:

Instability, which occurs when elbow joint ligaments are damaged, and the elbow is prone to dislocation.

Osteoarthritis (degenerative joint disease), which usually occurs in patients ages 50 and older, where the elbow cartilage deteriorates.

Post-traumatic arthritis, which may occur after a serious elbow injury and result in elbow bone fracture or tendon and ligament tear.

Rheumatoid arthritis, a disease where the synovial membrane surrounding the elbow joint thickens and becomes inflamed.

Severe fractures, which is when the elbow is shattered, and the blood supply to elbow bone pieces may be interrupted.

Though the DePuy elbow implant was designed to bring back working, comfortable elbow function to patients with elbow joint damage, its malfunctioning may require revision or corrective surgery.

Is This the First Time DePuy Has Been Held Liable?

Unfortunately, DePuy has a history of harming patients with defective medical devices. In 2010, DePuy issued a voluntary recall of two of its metal-on-metal hip implants, after data showed one in eight patients needed revision surgery in five years or less after the original procedure. DePuy has paid more than $2.5 billion to patients in settlements regarding this device.

DePuy is also currently facing more than 8,000 lawsuits involving its metal-on-metal Pinnacle device.

What Constitutes Defective Medical Devices?

Medical device manufacturers have a responsibility to properly test products before they are released. A product may be deemed defective if it:

  • Is rushed to market without proper testing
  • Has undergone testing that does not adequately identify potential dangers
  • Is released and has the potential to harm those who use it

When a victim is harmed due to a defective medical device, they may be eligible for compensation for medical bills, time missed off work due to injury and other costs.

There may be tens of thousands of patients who have experienced bodily damage due to defective medical product manufacturing by DePuy. Even if you or a loved one has not experienced pain yet, it’s imperative to check with your physician if you have had the DePuy elbow implant to watch for signs of damage. The loosening of the implant may not occur until several years after it has been implanted, but the danger is still there.

How Can Pittman, Dutton, Hellums, Bradley & Mann Help?

You expect the medical treatment you receive to help you, not hurt you. Unfortunately, in the case of the DePuy elbow implant, like other products it has manufactured, a device that is supposed to elevate quality of life can lead to stressful and painful complications.

We can help. We represent clients all over the country, fighting for justice when they are victims of defective medical devices.

If you have had a DePuy elbow implant, it’s imperative to talk with an attorney as soon as possible to get the compensation you deserve. We offer completely free consultations and can help you understand your rights and if it’s worth pursuing a claim.
