When Should You Hire a Hernia Mesh Attorney?
Are You a Hernia Mesh Victim?
Did you or a loved one have hernia surgery in which a mesh was implanted into the body? Reports have surfaced of men and women who have suffered from illness and injury, ranging from severe infections to the perforation and damage of internal body tissues, which may carry life-threatening complications and extensive hospitalization. Now, many victims are taking action by filing hernia mesh lawsuits against the manufacturers.
Multiple synthetic hernia mesh products are being investigated by our firm at this time, including products manufactured by C.R. Bard (also referred to as Davol), Covidien and Atrium.. The synthetic hernia mesh products are made from polypropylene material. It is believed that hundreds of thousands of these mesh products have been implanted in Americans and are failing at higher than normal rates requiring removal of the implant.

What Are the Most Important Facts About Defective Hernia Mesh?
The mesh products were fast-tracked to market without sufficient testing
Mesh products have been used for almost 20 years. The FDA allows manufacturers to utilize an approval process called “510(k)” which allows manufacturers to fast-track medical devices for approval to market and sell them without rigorous clinic trials or safety tests. All of the cases being pursued against C.R. Bard, Covidien, and Atrium were approved via the 510(k) process. Unfortunately for thousands of Americans, this process has only lead to severe injury and painful revision surgeries.

What is Important About the Atrium C-Qur Hernia Mesh?
The Atrium C-Qur product is a composite hernia mesh patch that began selling in 2006. This particular mesh has an Omega-3 Fatty Acid (03FA) coating over the mesh fibers. The Omega-3 coating was initially praised, however, it has now been known to cause severe allergic reactions.
But, even more alarming, the mesh can lead to life-threatening systemic infections due to lack of sterilization. The C-Qur hernia mesh can be used to assist with different types of hernias. Surgeons have used this exact mesh for chest and wall reconstructions, and even to treat traumatic and surgical wounds.
Once the C-Qur mesh is implanted into the body, doctors have discovered that it’s difficult to remove. Surgery to remove the mesh can cause even more hernia mesh complications for the patient. One of the worst aspects regarding this hernia mesh is the fact that not much testing was done before it was fast-tracked to the market under the FDA’s 510k approval process mentioned above. This is due to the similarity to a mesh approved in the 1990s. Nevertheless, the Atrium C-Qur hernia mesh is the first mesh to ever use an Omega-3 Fatty Acid coating, and this fact alone means that further testing should have been done.
The Atrium C-Qur Edge product was recalled on August 9th, 2013, however, our firm is investigating all C-Qur products.
What Are the Different Types of Atrium C-Qur Hernia Meshes?

Testimonial: This firm represented my mother in a case against a medical company. She had to go through multiple awful surgeries, and I was there during the recoveries which were pretty unbearable at times. They were kind, listened closely, and talked to her about her case often. She was happy with her settlement and she is glad just to have her life back on track and to put this matter behind her. – Lucy H. California
What Are Hernia Mesh Frequently Asked Questions?
- If I Live Out Of State, Can You Represent Me?
- If The Recall Was Several Months Ago, Why Have We Only Recently Heard About It?
- What Can I Expect If I Have A Conversation With Your Lawyers?
- When Do You Expect A Settlement Or Verdict?
Question: If I live out of state, can you represent me?
Answer: Yes, we can. Since hundreds of thousands of people have been potentially hurt and may file claims, the court system consolidates the cases to one single court that is likely not in your state. We have represented individuals from as far north as Alaska and Maine, to California and Florida. As long as you live in the United States we can help you.
Question: If the recall was several months ago, why have we only recently heard about it?
Answer: There could be a number of factors for not learning about the hernia mesh patch recall. As hundreds of thousands have been implanted, the notification process is slow, and the news media may not report the latest from the FDA hernia mesh recall.
Question: What can I expect if I have a conversation with your lawyers?
Answer: First and foremost, you can expect to have all your immediate questions answered. We believe in straight-talk and clear communication, and if there is a question we can not answer, such as if we don’t have medical records on your situation, we’ll tell you upfront. At our firm, we communicate with honesty and respect, as we know you may rely on what we have to say. When you are ready, call us today at (205) 322-8880 or us our contact form by clicking here.
Question: When do you expect a settlement or verdict?
Answer: It is early in the process. Some companies move more quickly than others when they feel they are accountable, while others can take months. Our goal is to move your case as quickly as possible while also working to achieve the maximum compensation for you. We know you want to recover, move on from this, and get back to enjoying your life. As your advocate, we intend to accomplish that goal.
What Are the Different Types of Hernias?
When an organ, intestine, or fatty tissue squeeze through a hole or weak spot in the surrounding muscle or connective tissue, a hernia takes place. Hernias are known to materialize at the abdominal wall, and can even be visible as an external bulge. The most common types of hernias include:
- Inguinal – Occurs In The Inner Groin
- Femoral – Occurs In The Upper Thigh/Outer Groin
- Incisional – Occurs Through An Incision Or Scar In The Abdomen
- Ventral – Occurs In The General Abdominal/Ventral Wall
- Umbilical – Occurs At The Belly Button
- Hiatal – Occurs In The Abdomen, Alongside The Upper Stomach/Diaphragm
Hernias can stem from a variety of reasons, but most are caused by a combination of pressure and opening or weakness of muscle or connective tissues. This muscle weakness can be present at birth but frequently appears later in an individual’s life. Furthermore, anything that causes an increase in abdominal pressure can create a hernia, such as obesity, lifting a heavy object, diarrhea or constipation, or constant coughing or sneezing. As well, poor nutrition, smoking, and overexertion can all play a part in the hernia process, as these acts can weaken muscles, ultimately setting the events into motion.
